Is family mediation required before going to court?

Under s60I of the Family Law Act 1975 (Cth), parties are required to attempt Family Dispute Resolution before making parenting applications to the Federal Circuit and Family Court of Australia, unless the matter involves family violence, risk of child abuse, or urgency. The mediator issues a Section 60I certificate confirming whether FDR was attempted — this certificate is required before most parenting applications can be filed.

How to Prepare for Mediation

It is important to enter the mediation with an open mind and a willingness to take part. Prior to the mediation, it is recommended that you write a checklist which contains:
