What does the Retail Leases Act 2003 (Vic) require?

Retail leases in Victoria are governed by the Retail Leases Act 2003 (Vic). The Act requires mandatory disclosure statements and generally provides for a combined lease term, including options, of at least five years unless the tenant obtains a five-year waiver certificate. It also regulates outgoings and certain costs that can be passed on to tenants. MST advises both landlords and tenants on meeting these obligations and avoiding disputes.

Our Commercial Leasing Services

We provide end-to-end commercial and retail leasing advice and support for both landlords and tenants across a wide range of industries and property types. Note we do not do residential leasing.

What should you check before signing a commercial lease?

Entering into a commercial lease is a significant step for any business. We help you understand your rights and obligations, ensure your lease aligns with your commercial objectives, and identify potential risks before they arise. MST Lawyers is experienced in handling leases for everything from small business premises to large-scale commercial properties.

Lease Negotiations and Drafting

Poorly drafted lease agreements can lead to future disputes or unexpected costs. Our team negotiates and prepares clear, enforceable lease documents that reflect your needs and reduce ambiguity. We work with clients across all sectors and understand the nuances that impact lease arrangements in different commercial contexts.

How do retail and office leases differ in Victoria?

Retail and office leases often involve unique legal requirements, particularly under Victoria’s retail leasing laws. We advise clients on compliance, disclosure obligations, and operational concerns. MST Lawyers has successfully supported numerous landlords and tenants in navigating these leases and achieving outcomes that support their growth.  Where a lease falls under the Retail Leases Act 2003 (Vic), specific obligations apply, including mandatory disclosure requirements and tenant protections. We advise both landlords and tenants on navigating these obligations.

How are commercial lease disputes resolved?

Disputes can arise over rent, repairs, make-good obligations, or lease termination. We act swiftly to protect your interests, aiming to resolve matters through negotiation or mediation where possible but with the readiness to litigate if needed. Our team’s goal is to minimise disruption and achieve cost-effective outcomes.

Lease Compliance and Risk Management

Leases must comply with numerous legal and regulatory requirements. MST Lawyers offers proactive audits and compliance reviews, helping clients identify potential issues and mitigate legal risks. We also advise on zoning, permitted use, and other operational matters that impact leasing obligations.
