Recent studies and programmes involving children’s views in parenting proceedings in Australia
The views of children in parenting litigation continue to be a topic of interest in the Australian family law landscape.
Australian Institute of Family Studies Releases Key Report Into Children Of Separated Families
The Australian Institute of Family Studies (AIFS) recently released findings from their study “Children and young people in separated families: Family law system experiences and needs”. (Copy available at this link.)
Dr Rachel Carson, Senior Research Fellow and her AIFS research team travelled the country and interviewed 61 children and teenagers over several years.
Key findings included:
- Children wanted to feel heard, most importantly about safety, but about all issues affecting them in the family law process;
- Children wanted feedback from those they deal with in the system about how their views had been considered in the decision-making Most children felt that they did not know if their views had been considered in the decision making.
Release of the Young People’s Family Law Advisory Group (YPFLAG) Report
Former Chief Justice of the Family Court, the Honourable Diana Bryant, AO QC, recently launched long-awaited YPFLAG report into pilot project commissioned by the Australian Government in conjunction with the Family Law Pathways Network named, the “Tip of the Iceberg”. Primarily, the main objectives of the YPFLAG were to:
- Obtain a comprehensive array of information from participants about a variety of issues concerning their experiences of all facets of the family law system;
- Prepare an evaluation about these findings;
- Assist participants of the YPFLAG in skill building, such as running a meeting, taking notes/minutes and other similar life skills.
Participants in the program spoke impressively of their experiences at the Australian Family and Conciliation Courts Conference on 18 August 2018 during the report launch.
