Couples separating in Australia sometimes find themselves wondering how might the Family Law courts deal with the family pet.

Overseas jurisdictions including, for example, in many states in America treat the family dog or cat as another child. Visitation rights can be given to both “parents”. 

Australian law has developed quite differently. 

Historically the family pet has historically been deemed by court to be an item of property to be distributed between the parties.
