Calling all Franchise Stakeholders – Have Your Say By 20th September

On Friday 23 August 2019, the Franchising Taskforce (established by the Government to examine the feasibility and implementation of recommendations proposed in the Parliamentary Joint Committee on Corporations and Financial Services’ Fairness in Franchising report) released an Issues Paper.

The Issues Paper invites input from the franchising community by asking 23 specific questions regarding 7 draft policy principles developed by the Taskforce.

The questions broadly cover issues relating to disclosure, cooling-off, mutual reporting, exploitation, dispute resolution, exiting franchise agreements and enforcement of the Franchising Code of Conduct.

Franchisors, franchisees and other stakeholders in the franchise sector are encouraged to read the Issues Paper and provide feedback on any or all of the issues raised. Responses are due by Friday 20 September 2019.

Any responses received by the Taskforce will be kept confidential and will not be published. The Taskforce has advised that any information used will have all identifying details removed.

The Taskforce has stated that it will use the feedback received to inform the development of its Regulation Impact Statement and its advice to the Government on its response to the Joint Committee Report.  There will be a further period of sector consultation later this year after the release of the Taskforce’s Regulation Impact Statement.
