Mary is a Principal.  She has extensive experience in the conduct of large scale litigation including property disputes, contractual disputes, trade practices disputes, joint venture disputes, insolvency, securities and product liability disputes. Mary regularly acts for clients instituting and defending injunctive proceedings.

Mary has acted for a number of publicly listed companies, property developers, major banks, financiers, manufacturers and private companies.

Mary’s experience includes:

  • acting for British American Tobacco Services Australia Limited on appeal to the Court of Appeal and High Court against Rolah Anne McCabe
  • acting for a global manufacturer defending privilege in documents which had been subpoenaed for production in proceedings brought by the Department of Justice in the United States
  • successfully defending Ford Credit Australia Limited in the Supreme Court of New South Wales in proceedings brought by a dealer for breach of contract, misleading and deceptive conduct and unconscionable conduct with a damages claim of $6 million
  • successfully acting for 138 claimants who had been misled and deceived by an authorised financial services licensee of Financial Wisdom Ltd (a wholly owned subsidiary of Commonwealth Bank of Australia) in a damages claim of $120 million
  • advising major banks and financiers on enforcement and protection of securities, negotiating work outs, frauds, receiverships, liquidations and voluntary administrations
  • advising insolvency practitioners in relation to receiverships, liquidations, voluntary administrations, deed of company arrangement and major preference claims
  • defending both listed and unlisted companies against claims for breach of director’s duties, false representations, misleading and deceptive conduct and breaches of the provisions of the Corporations Act
  • acting for manufacturers defending claims brought for allegedly defective products including allegations of design defects and claims that products are not fit for purpose and misrepresentation claims
  • acting on behalf of a large manufacturer in ACCC proceedings for breaches of the Trade Practice Act and compliance issues
  • implementing trade practices compliance programs
  • joint venture and property disputes
  • shareholders disputes and oppression proceedings
  • document retention obligation advice

Mary is the immediate Past President of  IWIRC  -  The Insolvency Professionals’ Network and has been a committee member since 2000.  She is an Associate Member of the Insolvency Practitioners Association of Australia, a member of the Law Institute Litigation Lawyers Section, a Committee Member of Law Institute of Victoria Ethics Liaison Group, a Member of the National Product Liability Association and a Member of the Banking and Financial Services Law Association.

Mary is completing a Master of Commercial Laws at the University of Melbourne.
