David Boyall

David is a Special Counsel. He has extensive practical experience in private and corporate legal practice.
David acts for importers, exporters, customs brokers and freight forwarders. He has acted as in-house counsel to a national customs broker and freight forwarder and as a senior adviser in a specialised trade consultancy.
David is able to support clients across a wide range of issues affecting importers and exporters. His experience includes:
- customs/anti-dumping enquiries concerning imports of building products and consumer goods
- overseas Customs audit of manufacturers' costs and prices representing the importer in anti-dumping enquiries
- acting for local manufacturers investigating potential instances of dumped competitive goods and preparing applications to Customs to initiate anti-dumping investigations
- acting for importers in relation to structuring of purchase contracts, royalties and buying commissions to minimise the Customs value of goods
- acting for importers in relation to reviews of Customs' decisions to refuse Tariff Concession Orders, including internal review and administrative law review
- acting for importers in relation to disputes with Customs over valuation of goods and refund of duty overpaid
- acting for importers in relation to disputes with shipping companies over loss and damage to goods in transit and detention of goods
- advising importers in relation to misclassification of goods and recovery of overpaid duty
- advising importers in relation to concessional relief available for infrastructure projects under the Enhanced Project By Law scheme
- advising on and documenting international distribution agreements for local importers
- conducting litigation in various jurisdictions for parties across a wide range of issues
- advising in relation to Austrade and other government assistance schemes for manufacturers and exporters including Export Market Development Grants and export finance
- advising on trading terms and conditions in relation to international trade arrangements
David's practical experience in private and corporate legal practice includes:
- advising in documenting a separation agreement arising from major $1m plus defalcation by director, restructuring the business and acting on subsequent sale of the business to an overseas purchaser
- acting for vendors and purchasers of share capital in manufacturing and wholesale enterprises
- acting as legal consultant to a specialised consultancy group in advising on legal implications for a peak electricity distribution body and a major gas transmission asset owner on regulatory issues in re-negotiation of tariff agreements
- acting for directors and liquidators in relation to insolvency matters arising under the Corporations Act including making and opposing winding-up applications and recovery of voidable and preferential payments by directors
David has also lectured and tutored in Trade law, Corporations law, Trade Practices and Marketing law at the Royal Melbourne Institute of Technology.
He was previously a partner in a commercial legal firm, a senior practitioner in a major national firm and in-house counsel with a specialised national semi-government entity.
